Jobot Privacy Notice

This Jobot Privacy Notice (the “Privacy Notice”) describes how Jobot collects and processes Personal Data and is issued on behalf of all members of the Jobot group of companies. "Jobot", "our" or "us" in this Privacy Notice is referring to the relevant legal entity in the Jobot group responsible for processing your Personal Data. This Privacy Notice supplements any other privacy notices and is not intended to override them. This includes, but is not limited to, any provisions in any contract, handbook, or other Jobot agreement, if and as applicable. 

This Privacy Notice does not apply to current and former employees of Jobot – whether Internal Employees or Consultants (as defined below) – or their dependents, spouses, or emergency contacts. In accordance with applicable law, these individuals receive a separate privacy notice at onboarding.

DEFINITIONS

“Business Contact” means an individual who works at, or represents, a client of Jobot.

“Candidate” means, collectively, a Direct Hire or an individual applying to be an Internal Employee or a Consultant.

“Consultant” means an individual who works for Jobot in the capacity of an employee whom Jobot assigns to work at Jobot’s clients on a temporary or contingent basis.

“Direct Hire” means an individual who works, or is applying to work, directly for a client of Jobot and that client is a company to which Jobot provides services.

“Internal Employee” means an individual who works for Jobot in the capacity of a direct internal employee of Jobot.

“Personal Data” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to any individual or a household.

“Processing” means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

PURPOSE OF PRIVACY NOTICE

This Privacy Notice is intended to explain:

NOTICE AT COLLECTION FOR CALIFORNIA RESIDENTS:

Jobot collects the Personal Data identified in Section 1 for the purposes identified in Section 3 and retains it for the period described in Section 6. We do not sell your Personal Data or disclose it for cross-context behavioral advertising (“sharing”). We also do not collect or process sensitive Personal Data for the purpose of inferring characteristics about you. To the extent you provide Jobot with Personal Data about other California residents, you are responsible for providing this notice to them.

PERSONAL DATA JOBOT COLLECTS

The categories of Personal Data collected may include the following. Not all categories apply to all individuals:

Any Individual:

  • Personal Identifiers: Including but not limited to your name, username or similar online identifier.

  • Contact Information: Including but not limited to your work and home addresses, telephone numbers, email addresses, and emergency contact details.

  • Network and Systems: To the extent you use Jobot’s internet and other electronic network activity information, Jobot may collect information about how you use our website, products and services using cookies (as discussed further below) and IT systems usage information related to your use of our equipment, systems, and other resources.

  • Data Submitted: Including but not limited to any data that you voluntarily submit through contact forms, resume, or cover letter.

  • Marketing Information: Including but not limited to your preferences in receiving marketing from us and our third parties and your communication preferences, email content, business letter content, business documents, and chat content.

Candidates: In addition to Personal Data collected from all individuals, Jobot may collect the following Personal Data from Candidates:

  • Employment Information: Including but not limited to information about your job, such as job title, category and status, work location, department, employment contract, assigned tasks and projects, weekly hours, supervisor's name, start and end date, and reason for leaving.

  • Education Information: Including but not limited to your education and training background.

  • Professional Information: Including but not limited to professional or employment related information and documents, such as prior work experience and any other information that may be included in your resume or job application, training, confidentiality agreements, and proprietary rights agreements.

  • Protected Characteristics: Including but not limited to, characteristics of protected classifications under federal, state (e.g., California), provincial law, such as your race, age, gender, national origin, citizenship, self-identification of disability, request for leave for family care, health condition, pregnancy, military or veteran status, and marital status. Jobot collects this information on a purely voluntary basis, except where collection is required by law, and used only in compliance with applicable laws and regulations, for diversity and inclusion reporting and related purposes.

  • Audio and Visual Information: Including but not limited to audio and visual information, such as photographs and phone and video recordings.

  • Social Media Platforms: Including but not limited to Personal Data, such as but not limited to name, contact information, location, education or work experience or other information that you make available on your public social network profiles and on other public locations, (e.g. Facebook, LinkedIn, Twitter, Instagram, or other company websites and/or job boards).

  • Health Information: For example, to respond to a health emergency or to protect against infectious disease, to the extent permitted by law

  • Sensitive Personal Data: Personal Data that is defined as “Sensitive Personal Data” under applicable privacy laws, for example, driver’s license, state identification card, passport, or other government issued identification card for purposes of identification. Jobot does not infer characteristics from sensitive Personal Data.

Client Contacts: In addition to Personal Data collected from all individuals, Jobot may collect the following Personal Data from Client Contacts:

  • Company Staffing Needs: If you are interested in working with Jobot for staffing needs and solutions, we may collect Personal Data related to you in connection with your company’s employment and staffing needs, including but not limited to your name, email or other contact information, your company name, job title, industry, location, etc.

CLIENT DATA COLLECTION

This Privacy Notice is directed solely to Jobot’s collection and use of your Personal Data. Clients of Jobot may also collect the Personal Data of Direct Hires and Consultants, and any such collection and use by clients shall be governed by the client’s privacy policies. 

INFORMATION YOU PROVIDE TO A THIRD PARTY

Jobot’s website may include links from the website to, and plug-ins (such as LinkedIn buttons) from, sites or applications operated by third parties (“Third-Party Sites”). Jobot does not control any Third-Party Sites and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by its privacy policy. It is your choice to enter any Third-Party Site. Jobot recommends that you read its privacy policy if you choose to do so.

CHILDREN’S PRIVACY

Jobot’s website and online services are intended for adult use only and are not directed towards children, minors, or anyone under the age of 18. If you are under the age of 16, you are not authorized to provide us with any Personal Data. If the parent or guardian of a child under 16 believes that the child has provided us with any Personal Data, please contact us at the email address below and ask to have this Personal Data deleted from our files.

HOW JOBOT COLLECTS PERSONAL DATA

Jobot may collect Personal Data from a variety of sources and methods. This includes, but is not limited to:

1) Information You Voluntarily Provide to Us – through applications, resume submissions, account creation, subscriptions to our publications, requesting marketing materials, applying for an open position, during your employment, contacting us to provide feedback, or attending any of our events, promotions, or other programs where Jobot collect information about you.

2) Information Jobot Collects When You Use Jobot Systems – Jobot collects Personal Data when you use Jobot systems, including computer systems, security systems, time keeping systems, and any internal intranet or online platforms. 

3) Information Jobot Collects When You Use Jobot’s Website – If you use one of our websites, Jobot may receive and store internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. When you access and use our website from your mobile devices, Jobot receives data from that mobile device. This may include your device ID, geographic location based on IP address, IP address, and device type. You may manage how your mobile device and mobile browser share location information with us, as well as how your mobile browser handles cookies and related technologies by adjusting your mobile device privacy and security settings. Please refer to instructions provided by your mobile service provider or the manufacturer of your device to learn how to adjust your settings.

4) Information Jobot Collects From Service Providers – Jobot collects Personal Data from service providers including where Jobot operates accounts on third-party platforms, such as recruiters, background check providers, employee benefit and insurance providers, training platforms, time keeping and payroll providers, communications and video conference providers, and other software and technology providers. 

5) Information Jobot collects From Other Third Parties – Jobot collects Personal Data from other third parties, such as job boards, auditors, and business partners, as well as public sources, for example, public databases and publicly available social media such as LinkedIn.

6) Government or administrative agencies – for example, law enforcement, the Internal Revenue Service, and other government authorities.

7) Acquired company – If Jobot acquired another entity, Jobot might collect Personal Data from that entity.

HOW JOBOT USES PERSONAL DATA

Jobot uses Personal Data for its legitimate business purposes, which vary depending on the individual’s relationship to Jobot. Not all purposes apply to every individual.

Any Individual:

  • To perform services, including maintaining or servicing accounts, providing customer service, and verifying Personal Data.

  • To promote Jobot.

  • To improve our products and services.

  • To facilitate communications with Jobot, for example, by collecting and organizing contact information, establishing means of communications, and corresponding, including regarding questions and feedback.

  • Informing about changes to the services, your account (if applicable), this Privacy Notice, or any other policies or terms in relation thereto.

  • Auditing related to a current interaction with the individual and concurrent transactions, including, but not limited to, counting impressions to unique visitors, verifying positioning and quality of impressions, and auditing compliance with the law.

  • To detect security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.

  • Debugging to identify and repair errors that impair existing intended functionality.

  • Short-term, transient use.

  • To exercise Jobot’s rights under applicable law and to support any claim, defense, or declaration in a case or before a jurisdictional and/or administrative authority, arbitration, or mediation panel.

  • To meet legal and regulatory requirements including civil discovery in litigation involving Jobot or affiliated companies.

  • To facilitate administrative functions, including, but not limited to, the management and operation of information technology and communications systems, risk management and insurance functions, budgeting, financial management and reporting, strategic planning, and the maintenance of licenses, permits and authorizations applicable to Jobot’s customers’/clients’ business operations.

  • To protect the rights, property, or safety of Jobot, you, or others.

Candidates:

The purposes listed above for any individual as well as:

  • For recruitment purposes.

  • To evaluate Candidates for internal jobs or placements with Jobot’s clients, including eligibility to work and background screening.

  • To identify potential job opportunities and facilitate job placement.

  • To keep you informed of Jobot services, opportunities, news, and wider developments in your chosen field.

  • To compile salary, surveys, and other analysis of Candidates.

  • To create a talent pool for future job openings.

Incidental Purposes: Any incident purposes related to, or in connection with, the above.

AGGREGATED AND DEIDENTIFIED INFORMATION

We may aggregate and/or deidentify information, use it internally, and disclose to third parties. Neither Aggregated Information nor Deidentified Information (defined below) is Personal Data.

“Aggregated Information” refers to information about a group of individuals from which the individually identifiable information has been removed. An example of Aggregated Information would be the statistic that 20 people used our website’s contact form on a given day. 

“Deidentified Information” means information subjected to reasonable measures to ensure that the deidentified information cannot be associated with the individual. An example of Deidentified Information would be the data point that an unidentified visitor first entered our website through our main web page. We maintain Deidentified Information in a deidentified form and do not attempt to reidentify it, except that we may attempt to reidentify the information just to determine whether our deidentification processes function correctly. 

PROFILING

Jobot does not conduct profiling in furtherance of decisions that produce legal or other similarly significant affects. “Profiling” means automated processing of Personal Data to evaluate, analyze, or predict personal aspects concerning an individual’s economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

HOW JOBOT DISCLOSES PERSONAL DATA

Personal Data You Direct Us to Disclose

Candidates: When Candidates apply for a position at a Jobot client, Jobot discloses the Candidate’s application for the purposes of evaluation, hiring, placement, and to comply with legal obligations. In addition, Jobot discloses a Candidate’s Personal Data to clients when directed by the Candidate to do so. Once disclosed to clients, a Candidate’s Personal Data is subject to the client’s privacy policies and practices.

Client Contacts: Upon the direction of a Client Contact, Jobot will disclose the Client Contact’s contact information to a Candidate to facilitate the job placements process.

Please note: Jobot will not share your phone number or SMS consent information with any third parties for marketing purposes. If you have consented to receive text messages from Jobot, you may receive text messages related to information about your application status, onboarding materials, other employment-related updates, or client assignments. Message and data rates may apply.

Personal Data Jobot Discloses for a Business Purpose

Service Providers: Jobot may use third-party service providers to perform certain business services on behalf of Jobot or the services and may disclose Personal Data to such service providers as needed for them to perform these business services. Service providers are only allowed to use, disclose or retain the Personal Data to provide these services. Business services provided include, but are not limited to, background check and employee eligibility providers, employee benefit and insurance providers, training platforms, time keeping and payroll providers, security and building access providers, healthcare providers, uniform companies, communications and video conference providers, internal social media platform providers, AI virtual assistant providers, and other software and technology providers. 

Auditors, lawyers, consultants, and accountants: For the business purpose of auditing compliance with policies and applicable laws, in addition to performing services on Jobot’s behalf.

Internal Third Parties: Jobot may disclose Personal Data to our parent company, subsidiaries and other related companies owned by or controlled by or under common ownership, who may use the Personal Data for the purposes described above.

All the categories of Personal Data that Jobot collects have been disclosed for a business purpose in the past twelve months to service providers, auditors, lawyers, consultants, accountants, and internal third parties.

Personal Data Jobot Discloses for Other Purposes

In addition to the above, Jobot may in the future do business with third parties to whom Jobot may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, Jobot may seek to acquire other businesses or merge with them. During the period leading up to and including the completion, if any, of a business transaction, your Personal Data may be collected, used or disclosed but such collection, use or disclosure will be restricted to purposes that relate to the business transaction. If a change happens to our business, then the new owners may use your Personal Data in the same way as set out in this Privacy Notice.

Also, subject to applicable law, Jobot may disclose Personal Data (i) if Jobot is required to do so by law, regulation or legal process, such as a subpoena; (ii) in response to requests by government entities, such as law enforcement authorities; (iii) when Jobot believes disclosure is necessary or appropriate to prevent physical, financial or other harm, injury or loss; or (iv) in connection with an investigation of suspected or actual unlawful activity.

Jobot Does Not Sell or Share Personal Data

Jobot does not sell or share your personal information where “share” means disclosing personal information to third parties for cross-context behavioral advertising. Without limiting the foregoing, we have not, and have no actual knowledge that we have, sold or “shared” the personal information of individuals of any age, including the personal information of children under 16, in the last 12 months. 

HOW JOBOT PROTECTS PERSONAL DATA

Jobot has technical, administrative, and physical security measures in place designed to protect your Personal Data from unauthorized access or disclosure and improper use. For example, Jobot uses Transport Layer Security (TLS) encryption to protect the data collection forms on our website. In addition, Jobot restricts access to your Personal Data to employees who need the Personal Data to perform a specific job (for example, a customer service representative). Employees with access to Personal Data are kept up-to-date on our security and privacy practices. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to close your browser after you have completed your visit to the website or any of our online systems. Please note that despite our reasonable efforts, no security measure is ever perfect or impenetrable, so Jobot cannot guarantee the security of your Personal Data.

PERSONAL DATA RETENTION

For each of these categories of Personal Data, Jobot will retain the information as long as is reasonably necessary to fulfill the purpose for which it was collected and to comply with applicable laws and regulations. Jobot considers the following criteria when determining how long to retain Personal Data: why Jobot collected the Personal Data, the nature of the Personal Data, the sensitivity of the Personal Data, our legal obligations related to the Personal Data, and the risks associated with retaining the Personal Data.

PERSONAL DATA RIGHTS

Subject to applicable law, you may have the following rights with respect to your Personal Data. This section describes these rights and how to exercise them, if applicable. All rights are subject to legal limitations and exceptions.

Right to Know: The right to know whether Jobot has Personal Data about you, details about how Jobot processes that Personal Data, and to know what Personal Data Jobot has.

Right to Delete: The right to request that Jobot delete your Personal Data.

Right to Correct: The right to correct inaccurate Personal Data that Jobot maintains about you.

Right of Portability: The right to obtain Personal Data that you provided to Jobot in a readily usable format that allows you to transmit the data to another business without hindrance.

Right to Non-Discrimination: Jobot will not unlawfully discriminate against you for exercising any privacy rights.

Exercising Your Rights

Requests can be submitted by clicking Data Rights Request Form or calling our toll-free number +1 888.592.3804 or by contacting privacy@Jobot.com or the HR Department at peopleops@jobot.com if you are a current employee.

Only you, or a person that you authorize to act on your behalf, may make a request related to your Personal Data.

Authorizing an Agent to Act on Your Behalf

Except where you have provided an agent with a Power of Attorney pursuant to Sections 4000 – 4465 of the California Probate Code, when using an authorized agent you must: (1) provide the agent with signed written permission clearly describing their authority to make a request on your behalf; (ii) verify your own identity; and (iii) directly confirm that you have provided the authorized agent permission to submit the request. Jobot may deny a request from an authorized agent if the agent does not provide us with the signed written permission demonstrating that they have been authorized to act on your behalf.

Verifying Your Request

We must verify your identity prior to complying with a request to know, correct, delete, or exercise the right of portability. The verifiable consumer request initiated by you or your authorized agent must:

Include your full legal name, and a secure email address, which Jobot will need to contact you in order to verify that you are the person about whom Jobot collected Personal Data or an authorized representative.

Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Making a verifiable request does not require you to create an account with us. One of our representatives will contact you in order to verify your identity. You may need to provide additional information in order to verify your request. Depending on the nature of the request, Jobot may require additional verification actions be taken. Jobot will only use this information to verify the requestor’s identity or authority to make the request.

Response

Jobot does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If Jobot determines that the request warrants a fee, Jobot will tell you why Jobot made that decision and provide you with a cost estimate before completing your request.

REGION-SPECIFIC INFORMATION

Canada

Jobot makes commercially reasonable efforts to keep your Personal Data complete, up-to-date and accurate.

Jobot may transfer your Personal Data outside Canada to its affiliates, third party service providers, and potential employers with operations in other countries, which are subject to laws of a foreign jurisdiction. Jobot uses contractual or other means to provide a comparable level of protection while Personal Data is being processed by a third party. By accepting this Privacy Notice and providing us with your Personal Data you acknowledge and consent to your Personal Data being processed by third parties and being transferred, accessed and/or stored in countries outside Canada. 

Quebec Residents

If you are a resident of Quebec, you have certain additional rights under applicable data protection laws. These may include the rights (i) to restrict dissemination of your Personal Data or to have your Personal Data de-indexed from search results (the right to be forgotten); (ii) to be informed when your Personal Data was used to render a decision based exclusively on automated processing and to request further information about the automated decision-making; and (iii) to data portability. If you have a request regarding these rights, please contact our Privacy Officer at privacy@Jobot.com. Jobot will consider and act upon any request in accordance with applicable data protection laws.
